Death in service benefit?

My Dad had death in service benefit. It has been paid to the 4 children, each receiving a personal cheque. My brother who is the executor of the estate has told us not to touch the money as Dad had an outstanding balance on a loan and he is worried they will come for the money. The money was left in trust, and never belonged to my Dad so surely they can't touch this??? can they?????
